Liability Waiver

RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND WAIVER AGREEMENT

 

 Please read this document carefully. This is a legal document that affects your rights.

 

  By booking an experience with Wilderness Café, you acknowledge that you have read, understood, and agree to the terms of this waiver.

DESCRIPTION OF ACTIVITIES

 

  Participants in Wilderness Café experiences are voluntarily participating in outdoor wellness activities which may include, but are not limited to:

 

  • Hiking on mountain trails and wilderness areas

  • Outdoor yoga and stretching activities

  • Meditation and sound bath experiences

  • Breathwork exercises

  • Coffee ceremonies and beverage service

  • Mindful nature walks and wilderness immersion

  • Other outdoor recreational and wellness activities

 

  These activities will take place in the San Bernardino National Forest and surrounding mountain wilderness areas, which may include remote locations with limited access to emergency services.

ACKNOWLEDGMENT OF RISKS

 

  Participants acknowledge and understand that the activities involve inherent risks, hazards, and dangers that cannot be eliminated without fundamentally changing the nature of the experience. These

  risks include, but are not limited to:

 

  Environmental and Wilderness Risks:

  • Uneven, slippery, rocky, steep, or unstable terrain

  • Weather conditions including extreme heat, cold, wind, rain, snow, or lightning

  • Encounters with wildlife, insects, and plants (including poisonous plants)

  • Remote locations with limited or delayed access to emergency medical services

  • Falling rocks, trees, branches, or other natural debris

  • Exposure to sun, dehydration, hypothermia, or altitude sickness

  • Getting lost or separated from the group

 

  Activity-Specific Risks:

  • Physical exertion beyond current fitness level

  • Strains, sprains, fractures, or other musculoskeletal injuries from yoga, stretching, or hiking

  • Slips, trips, and falls on trails or during activities

  • Adverse reactions to breathwork or meditation practices (dizziness, hyperventilation)

  • Sound bath experiences may cause emotional release or discomfort

  • Injuries from equipment used during activities

 

  Food and Beverage Risks:

  • Allergic reactions to food or beverages served

  • Foodborne illness

  • Hot beverage burns or scalds

 

  Other Risks:

  • Acts or omissions of other participants

  • Equipment failure or malfunction

  • Participant's own physical or mental condition

  • Serious injury, permanent disability, or death

 

  This list is not exhaustive and other risks, known or unknown, may exist.

 

  

  ASSUMPTION OF RISK

 

  Participants expressly and voluntarily assume all risks associated with participation in Wilderness Café activities, whether those risks are known or unknown, foreseen or unforeseen. Participants

  understand that:

 

  • They are responsible for their own safety and well-being

  • They will follow all instructions provided by Wilderness Café guides and staff

  • They will immediately inform staff of any concerns, discomfort, or unsafe conditions

  • They have the right to refuse to participate in any activity at any time

  • They are participating in these activities of their own free will

 

  Participants certify that they are physically and mentally capable of participating in these activities. Participants acknowledge that it is their responsibility to consult with a physician prior to

  participation if they have any concerns about their health or ability to safely participate.

 RELEASE OF LIABILITY AND WAIVER

 

  In consideration for being permitted to participate in Wilderness Café activities, participants hereby release, waive, discharge, and covenant not to sue Wilderness Café, its owner(s), operators,

  guides, employees, agents, volunteers, and any affiliated individuals or entities (collectively, "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising

  out of or related to any loss, damage, injury, or death that may be sustained by participants or their property while participating in such activities, whether caused by the ordinary negligence of

  the Released Parties or otherwise, to the fullest extent permitted by California law.

 

  This release does not extend to claims for injuries caused by gross negligence, recklessness, or intentional misconduct by the Released Parties.

 

  

  INDEMNIFICATION

 

  Participants agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney's

  fees, arising out of or related to their participation in Wilderness Café activities, to the fullest extent permitted by law.

 

  

  MEDICAL TREATMENT AUTHORIZATION

 

  Participants authorize Wilderness Café staff to:

 

  • Administer basic first aid if needed

  • Call emergency medical services (911) on behalf of participants if necessary

  • Transport participants to a medical facility if required

  • Share participant emergency contact information with medical personnel

 

  Participants understand that they are responsible for all costs associated with any medical treatment they receive.

 

  Participants are required to disclose all relevant medical conditions, injuries, allergies, and medications on the reservation form.

 FOOD AND BEVERAGE ACKNOWLEDGMENT

 

  Participants must disclose any and all food allergies, dietary restrictions, or sensitivities on the reservation form. While Wilderness Café will make reasonable efforts to accommodate participant

  needs, participants are ultimately responsible for their own food safety and consumption decisions.

 

 

  PHOTO AND MEDIA RELEASE

 

  By participating in Wilderness Café experiences, participants grant permission for Wilderness Café to use photographs, videos, or other media taken during activities for marketing, promotional, and

  social media purposes, unless they have specifically opted out on the reservation form. Participants will not receive compensation for such use.

 

 

  ACKNOWLEDGMENTS

 

  By completing the reservation form and checking the waiver agreement box, participants acknowledge that:

 

  1. They have read this entire document and understand its contents

  2. They have had the opportunity to ask questions and seek clarification

  3. They are agreeing to this waiver voluntarily and of their own free will

  4. They understand this is a legal document that affects their rights

  5. They are at least 18 years of age (or their parent/legal guardian has agreed on their behalf)

  6. This agreement is binding on their heirs, executors, administrators, and assigns

  7. This agreement shall be governed by and construed in accordance with California law

  8. If any provision of this agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect

  PARENT/LEGAL GUARDIAN CONSENT (For participants under 18)

 

  If a participant is under 18 years of age, their parent or legal guardian must complete the reservation form on their behalf. By doing so, the parent/guardian acknowledges that they have read and

  understood this agreement and agree to its terms on behalf of the minor. The parent/guardian understands that they are not only giving consent for the minor to participate, but are also binding

  themselves, the minor, and all parties who may claim through them to the terms of this agreement.

 

 

 CANCELLATION AND REFUND POLICY

 

  Participants understand and agree to Wilderness Café's cancellation and refund policy as communicated at the time of booking.
